Garland had never been to Evansville prior to accepting an associate position in 1982 with then prominent local estate planning attorney, William D. Powell. Originally from Clark County, Indiana, Garland quickly found Evansville and the civility of its legal community very much to his liking. Garland became a law partner with Mr. Powell in 1986, but their partnership lasted only a few months due to Mr. Powell’s unexpected death in early 1987. It was at that time that Garland and John B. Whinrey merged their separate practices resulting in what would eventually become our present firm.

Although Garland also practices in the areas of estate planning and administration, business and corporate law, and domestic relations, much of his practice is in the real estate area, including title insurance and real estate closings. Garland has also developed expertise in the field of Medicaid planning, dealing with issues of eligibility and asset preservation. He enjoys the challenges that this seemingly ever-changing area of the law provides and he takes great satisfaction in assisting elderly clients and their families who find themselves suddenly facing the expense and uncertainties of a permanent nursing home placement.

Mark began his legal career in 1995 at a large Evansville law firm representing clients in a variety of matters including creditor rights, insurance and commercial litigation, and labor and employment. He then joined a nation-wide Evansville-based corporation as its corporate counsel. After realizing he missed private practice and the relationships he enjoyed with his clients, Mark joined a small specialized firm in Louisville, Kentucky, and focused almost exclusively on representing employers in labor and employment law matters. Mark joined our firm in January 2006 and was made a partner in 2008. Licensed to practice law in Indiana, Illinois, and Kentucky, Mark has represented clients across the tri-state area. Mark is also licensed in Missouri.

Mark is not satisfied in being known as a good lawyer – there are many good lawyers – but strives to act as a valued advisor and counselor to his clients. In this regard, his experience in private practice and the corporate world has been of great benefit. In private practice, Mark has advised and represented clients in a variety of courts and administrative proceedings. In his role as corporate counsel, he worked with attorneys across the country to help manage legal matters. In short, Mark has been both lawyer and client, and these experiences allow him to see the "big picture."

Originally from Muncie, Indiana, John began his legal career in 1967as an associate in one of Evansville’s larger law firms. Although John soon became a partner in the firm, he eventually became frustrated with practicing law in a large firm. Realizing he needed a change, he opened his own practice in 1982. John approaches the practice of law by attempting to place himself in the position of his clients. He strives for understandable documents, thorough communication, high ethics, and reasonable billing. As our firm’s senior law partner, John insists that these concepts are considered in every aspect of our firm.

John believes deeply in giving back to the community. He has been involved in numerous community and church activities since his arrival in Evansville in 1967. He is a stickler for detail and preparation. John’s father taught him at an early age that "if you do a good job of gathering facts, the decisions will come easily."

Originally from Elkhart, Indiana, David joined our firm as an associate in 1996 and became a partner in 2001.

David prides himself on his organizational skills and his attention to detail. He takes every client matter, no matter how big or small, seriously and works hard to obtain the best result for the client, often putting in much more time for the client than he bills. David is also very generous with the giving of his time and talents to numerous charities and pro bono matters. David approaches every legal matter as if he were the client, and he works hard to provide high quality legal services, both quickly and economically.

David studied aviation at Indiana State University and obtained his private pilot certificate and instrument rating. Although David rarely gets a chance to fly anymore, he still enjoys "tinkering" with technology and he is the person at our firm that is primarily responsible for keeping us current with the latest technologies.
